In late 2015 a discussion started on this Forum about due diligence. While we had no idea how section 44 of the Health and Safety at Work Act would work in practice a range of ideas for compliance were suggested. At the time I was finishing my PhD and decided to write an article about due diligence and its origins. The article was published in early 2017 and remains the only academic article on the subject.
Recent court cases and developments make it worth revisiting the subject. Can you help with my follow-up research? I am trying to find out how officers comply with their due diligence obligations, and how managers, health and safety practitioners and consultants help them.
